Grant Smereczynsky wants the city to rezone the disputed property from R-I to R-II.
The planning staff recommends denial, saying Smereczynsky is merely trying to circumvent the city's regulations calling for "stick-built" houses only in Waters Edge. The staff's report says there's another factor, as well. "While the proposed industrialized home is a single-family use, the application for rezoning the property to R-II is not consistent with the rezonings of the adjacent properties and is not compatible with the zoning of the entire neighborhood," it reads.
The lot in question contains a partially-constructed industrialized house. The city ordered that work on the house stopped last year because officials say such structures are not permitted in areas zoned R-I.
Smereczynsky took the city to court, but lost one round in Hall County Superior Court a few months ago. However, Smereczynsky vowed at that time to keep fighting because, he claims, the state Department of Community Affairs is on his side.
