ATLANTA -- A Buford nursing home listed among the 54 worst in the nation should not have been included, a federal agency said Friday.

The home, Laurel Baye Healthcare of Lake Lanier, was removed from the list after officials of the home complained that an outdated inspection was used to judge its performance.

The Georgia Department of Human Resources said Thursday that the inclusion of Laurel Baye Healthcare on the list was an error.

The list compiled by the Centers for Medicare and Medicaid Services was intended to pressure targeted nursing homes into improving care.

On Friday, Jeff Nelligan, spokesman for the Centers for Medicare and Medicaid Services, admitted the mistake.

"CMS has determined that the Laurel Baye nursing home in Lake Lanier, Georgia, qualifies for removal from the SFF list," he said in a statement. "We have contacted the Laurel Baye nursing home officials and have apologized for the mistake. We deeply regret the error and are removing Laurel Baye from the listing that appears on our web site."
