Hall Planners deny rock company again

GAINESVILLE - After a two-hour Hall County Planning Commission hearing Monday night, the best Atlanta attorney Wayne Phears could do was a 3-2 denial of a rezoning request to allow Hanson Aggregates Southeast LLC to expand its rock quarry off Candler Road in Southeast Hall County. Phears represents Hanson and he made several promises and concessions to hostile homeowners who live near the quarry or have property there.

One of those promises was giving residents to option of getting on city water at company expense if the company was at fault for a well failure, or digging them a new well.

Planning Commission Chairman Don Smallwood wanted a yes or no answer on providing city water; Phears asked for another 30 days for clarification on whether Hanson could do that; he did not get it and the Commission voted 3-2 to deny the rezoning request and forward it to Hall County Commissioners for a final decision.
Smallwood and Chris Braswell voted for the rezoning with Jones Cottrell, Johnny Varner and Bill Evans opposed.

The Hanson hearing was also filled with objections from property holders who feared rezoning 113 acres would bring even more problems for them.

Barbara Brooks said for her it was a family heritage issue. Others, including Dr. David Cohen, told commissioners his house shakes when the quarry is blasting for rock and called it a nuisance. Judy Sellers feared declining property values even with Hanson's promise to 'fix' things with their blasting damage and water well protection programs.

Planning Commission staff recommended approval of Hanson's request with 11 conditions that included extensive buffers and set hours for blasting on the rezoned property.
