GAINESVILLE - Gainesville City Council decided to give a downtown restaurant and lounge a break even though the business admitted violating the alcohol beverage license ordinance.

Tiffiny Smith-Harrison explained during her revocation appeal hearing she was struggling against economic times and was not able to run the NV Lounge on Bradford Street full time required by the ordinance and that she did not have a state alcohol permit. Mayor Ruth Bruner said Council wanted to be supportive.

"We understand how restaurants struggle," the Mayor said. "We want to see our downtown businesses strive and we want you to have a chance."

Council decided to suspend the license until NV gets the state permit; then the lounge is on six months probation and is required to make bi-monthly reports on the amount of food served with the amount of alcohol. Any ordinance violation would result in an automatic revocation.

Harrison said she did not understand she violated the ordinance at a January private event where patrons were provided with alcohol from a source other than a whole sale distributor, another ordinance requirement. Police also cited the lounge because patrons were smoking inside, in violation of the city's smoking ban, despite repeated warnings to go outside and smoke.

"We're going to get our state license and see if we can make some revenue and get some money going," Harrison said.
