Habersham Schools named in federal complaint

GAINESVILLE - The Habersham County School District is the defendant in a lawsuit filed in Gainesville Federal Court.

Habersham Schools is accused of misclassifying payroll officer Janie Franklin as an exempt employee and violating the Fair Labor Standards Act, denying her overtime pay; Franklin wants back pay, damages and attorneys' fees.

Franklin, system payroll officer for 26 years, claims she performed non-exempt labor that was more than 40 hours per workweek and she was not paid for it. During most of her employment she was classified as non-exempt according to the complaint and paid time and a half.

From July 2008 until November 2011 Superintendent Robert Costley classified Franklin as exempt from FLSA overtime regulations and refused her overtime pay requests. Costley left his job and his replacement, Interim Supt. Larry Hill, again classified Franklin as non-exempt and paid for the overtime she worked.

The complaint claims the school district's failure to pay Franklin her overtime was "willful and done in bad faith."
