ATLANTA (AP) The family of the fan who plunged to his death last year from an upper deck at Turner Field has filed a lawsuit against the Atlanta Braves and Major League Baseball.

The Atlanta Journal-Constitution (http://bit.ly/1WErsBt ) reports that the family of 60-year-old Gregory Murrey filed the lawsuit Tuesday in Fulton County State Court, accusing the defendants of disregarding fans' safety by putting up a guard railing that is only 30 inches tall. The lawsuit says that height is 12 inches short of the industry standard.

Murrey, of Alpharetta, Georgia, died after falling into a lower-level stand during an August game against the New York Yankees.

The Atlanta Braves declined to comment on the lawsuit.

Since 2008, three people have died after falls at Turner Field, including one death that was ruled a suicide.
