High court says suit over guns at Atlanta garden can proceed

ATLANTA (AP) Georgia's highest court has sent a lawsuit filed by a gun rights group against the Atlanta Botanical Garden back to Fulton County Superior Court.

The Supreme Court's ruling released Monday doesn't affect operations at the garden. But the opinion says a Fulton County judge was wrong to dismiss the suit filed by gun rights group GeorgiaCarry.org and the suit should continue.

Court documents say Philip Evans, a group member with a state firearms license, was escorted out of the botanical garden in 2014 for wearing a handgun in a waistband holster. His attorney argues that the garden leases land from the city of Atlanta and cannot keep properly licensed people from carrying weapons there.

Attorneys for the garden have argued the lease to a private company makes the land private.
