Gwinnett Police find missing boy and father at restaurant

Gwinnett County Police Friday said they found the father and son, subjects of an Amber Alert out of Habersham County Thursday night, at a restaurant.

Roy Ivan Montesinos II, 25, was taken into custody at a McDonalds restaurant on McDonough Drive in Norcross, according to Corporal Jake Smith of the Gwinnett County Police Department.

Smith said officers were directed to the restaurant where two were.

"The son, the child was in good health, and the father was actually placed under arrest and taken to the Gwinnett County Jail," Smith said.

"It all took place without incident. There was no struggle or attempt to run or resist arrest," Smith added.

The Habersham County Sheriff's Office issued the alert around 11:30 p.m. Thursday for Montesinos and his five year old son by the same name.

"The suspect (Montesinos) broke into the house and was hiding. She (mother) came home with the child and evidently, I guess, her new boyfriend. He (Montesinos) somehow got the child and got out of the house," Habersham County Sheriff Joey Terrell said.

CBS Atlanta reported that the child has been returned to his mother.
