State Supreme Court to hear arguments in 2018 lawsuit against Athens childcare center

Oral arguments are scheduled to be heard before the Georgia Supreme Court Tuesday behind a Clarke County trial ruling over a 2018 personal injury lawsuit.

The operator of Athens-based University Childcare Center is appealing a State Court decision that reversed a Clarke County court’s judgment in a lawsuit filed by Andrea Leah Cotton..

Cotton sued the childcare center after an employee crashed into her truck while attempting to call her supervisor as she drove to work in 2018.

Although the trial court initially granted judgment to the childcare center’s parent company, Prodigies Child Care Management LLC, the Court of Appeals ruled that Cotton presented sufficient evidence to allow a jury to decide whether the employee was acting within her job’s duties during the crash.
